Terms and Conditions

§1 Scope

These terms and conditions apply to all contracts between Lumeries (Waleria Cenaj, Bruchstr 75, 41812 Erkelenz, Germany, email: hello@lumeries.com) and consumers or businesses regarding the purchase of digital products (personalized posters as image downloads) via the website lumeries.com.

§2 Conclusion of contract

The presentation of products on our website does not constitute a legally binding offer, but an invitation to submit an offer (invitatio ad offerendum).

The contract is concluded when you complete the order process and payment via Stripe is successfully processed. You will then receive a confirmation email at the email address you provided.

§3 Prices and payment

All stated prices are final prices. As we make use of the small-business regulation pursuant to §19 of the German VAT Act (UStG), no VAT is shown.

Payment is processed via the payment service provider Stripe, Inc. (185 Berry Street, Suite 550, San Francisco, CA 94107, USA). Accepted payment methods: credit card, PayPal, Klarna, SEPA direct debit, Apple Pay, Google Pay.

Your payment method is charged upon completion of the order.

§4 Delivery of digital content

After successful payment, you receive a download link by email. The digital files (high-resolution image) are available for download immediately after payment confirmation.

The download link is valid for 7 days and can be used up to 10 times. If you have any problems downloading, please contact us at hello@lumeries.com.

§5 Usage rights

With the purchase you acquire a simple, non-transferable right to use the downloaded files for private, non-commercial purposes.

The following is not permitted:

• Reselling or passing the files on to third parties
• Commercial use (e.g. printing for resale)
• Modifying and distributing modified versions
• Use for NFTs or digital art marketplaces

§6 Right of withdrawal

As a consumer, you generally have a 14-day right of withdrawal. For digital content, however, the right of withdrawal expires early if you expressly agree that we begin performing the contract before the withdrawal period expires and you have confirmed your awareness that you thereby lose your right of withdrawal (§356 para. 5 German Civil Code, BGB).

§7 Warranty and liability

We warrant that the digital products have the advertised characteristics and are available for download. In case of technical problems with the download, please contact hello@lumeries.com — we will resolve the issue promptly.

Our liability is limited to intent and gross negligence, unless material contractual obligations are breached. Liability for data loss is limited to the typical recovery effort.

§8 Data protection

Information on the processing of your personal data can be found in our privacy policy.

§9 Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

Should individual provisions of these terms be invalid, the validity of the remaining provisions remains unaffected.

The place of jurisdiction for merchants and legal entities under public law is Erkelenz, Germany.
